1. Acceptance of Terms

These Terms of Use and Medical Disclaimer (“Terms”) form a legally binding agreement between you (“User”, “you”, or “your”) and Kiala Technologies Private Limited, a company incorporated under the laws of India, with CIN U46491KA2025PTC201557, having its registered office at NO 16, Lakshmi Nilaya, 2nd Main, 3rd Cross, Muneshwara Layout, Doddabommasandra, Vidyaranyapura, Bangalore North, Bangalore, Karnataka, India, 560097 (“Company”, “we”, “us”, or “our”).

By downloading, accessing, or using the Zuno.Fit mobile application, the website zuno.fit, or any related services (collectively, the “Platform”), you agree to be bound by these Terms in their entirety. If you do not agree, you must not use the Platform.

2. Eligibility

2.1 Age Requirement. You must be at least 18 years of age to use the Platform. By using Zuno.Fit, you represent and warrant that you are 18 years or older.

2.2 Legal Capacity. You represent that you have the legal capacity to enter into binding contracts under Indian law and are not prohibited from doing so under any applicable law.

2.3 Account Information. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3. Medical Disclaimer

3.1 General Nature of the Service

Zuno.Fit is a digital fitness and nutrition information service. It is NOT a medical device, NOT a healthcare service, NOT a telemedicine platform, and NOT a registered medical practice. The Platform does not provide medical diagnosis, treatment, prescription, or professional medical services of any kind.

3.2 No Doctor-Patient or Healthcare Relationship

Use of the Platform does not create:

  • A doctor-patient relationship
  • A dietitian-client relationship
  • A nutritionist-client relationship
  • A certified personal trainer-client relationship
  • Any other healthcare professional-client relationship

All content is generated by automated systems (artificial intelligence) and is general informational content, not personalized medical advice.

3.3 AI-Generated Content Disclaimer

Important — Understanding AI Output:

Workout plans, meal plans, recipes, recommendations, and informational content within Zuno.Fit are generated by artificial intelligence systems (such as large language models). You acknowledge and agree that:

  • AI systems can produce inaccurate, misleading, incomplete, or unsuitable information
  • AI-generated content is NOT reviewed by a licensed medical doctor, registered dietitian, or certified fitness professional before being shown to you, unless explicitly stated otherwise
  • AI cannot account for medical conditions, medications, allergies, or individual circumstances that have not been disclosed to it, and even if disclosed, may not appropriately tailor recommendations
  • AI recommendations are based on general data patterns and may not be appropriate for your specific physiology, health status, or goals
  • You retain full responsibility for evaluating whether any AI-generated recommendation is safe and suitable for you
3.4 Mandatory Consultation with Healthcare Professionals

3.4.1 Before You Start. You agree to consult with a qualified medical doctor, registered dietitian, or certified fitness trainer BEFORE:

  • Starting any exercise program or workout plan from the Platform
  • Changing your diet or nutritional intake
  • Following any meal plan, recipe, or nutritional recommendation
  • Beginning any supplementation regime
  • Making any significant lifestyle change based on Platform content

3.4.2 Continued Medical Care. You agree to:

  • Continue all prescribed medications and medical treatments
  • Not stop, alter, or change any prescribed treatment based on Platform content without first consulting your physician
  • Inform your healthcare providers that you are using Zuno.Fit
  • Share any plans generated by Zuno.Fit with your doctor or dietitian for their review and approval
3.5 Users with Medical Conditions — Special Provisions

If you have any current or past medical condition, including but not limited to those listed below, you acknowledge that you must obtain specific medical clearance before following any plan or recommendation:

  • Type 1 or Type 2 diabetes
  • Polycystic Ovary Syndrome (PCOS) or any other endocrine disorder
  • Hypertension or any cardiovascular condition
  • Hypothyroidism, hyperthyroidism, or any thyroid disorder
  • Fatty liver disease or any liver condition
  • Irritable Bowel Syndrome (IBS), inflammatory bowel disease, or any gastrointestinal disorder
  • High cholesterol or any lipid disorder
  • Pregnancy, planning pregnancy, or breastfeeding
  • Current or past eating disorders (anorexia, bulimia, binge eating disorder, ARFID, etc.)
  • Kidney disease or any renal condition
  • Cancer or post-cancer recovery
  • Recent surgery (within the past 6 months)
  • Mental health conditions including depression, anxiety, or psychiatric disorders
  • Musculoskeletal conditions, injuries, joint problems, or chronic pain
  • Allergies, food intolerances, or autoimmune disorders
  • Any other chronic illness, acute illness, or undiagnosed symptoms

3.5.1 Consent Gating. If you disclose a medical condition during onboarding or at any point during use, the Platform will display additional warnings and require you to acknowledge that:

  • You have consulted, or will consult, your treating physician
  • You understand the recommendations are general and not tailored to your specific medical situation
  • You accept full responsibility for following or modifying the recommendations
  • You will monitor yourself for adverse effects and seek medical attention if any occur

3.5.2 Pregnancy and Breastfeeding. If you are pregnant, planning pregnancy, or breastfeeding, you MUST consult your gynecologist and a registered dietitian before following any plan. The Platform will generate pregnancy-conscious content if pregnancy is disclosed, but such content is general in nature and not a substitute for prenatal medical care.

3.5.3 Mental Health and Eating Disorders. If you have a current or past eating disorder, disordered eating, or significant mental health concerns related to body image, weight, or food:

  • Use of calorie tracking, weight tracking, or aggressive caloric deficit features is strongly discouraged
  • You should consult a mental health professional and registered dietitian familiar with eating disorders before using the Platform
  • The Platform will display helplines and resources, including the National Alliance for Eating Disorders helpline, in relevant sections
3.6 Emergency Situations

Medical Emergencies.

If you experience any of the following, stop using the Platform immediately and seek emergency medical attention:

  • Chest pain, shortness of breath, or signs of a heart attack
  • Severe dizziness, fainting, or loss of consciousness
  • Severe allergic reactions (anaphylaxis)
  • Severe abdominal pain, vomiting, or signs of dehydration
  • Any other medical emergency

Call your local emergency services (112 in India) or visit the nearest hospital. Do not consult the Platform in an emergency.

3.7 Reporting Adverse Events

If you experience any adverse health effects, injuries, or negative consequences that you believe may be related to your use of the Platform, you must:

  • Stop using the Platform immediately
  • Seek medical attention
  • Report the event to us at safety@zuno.fit with details of what occurred

We will review reports of adverse events and take appropriate action, including potentially adjusting the Platform’s recommendations or content.

4. Subscription, Billing, and Cancellation

4.1 Trial Subscription

Zuno.Fit offers a paid trial of ₹99 for 15 days. By starting the trial, you authorize us to charge ₹99 to your selected payment method. The trial does not auto-renew into a subscription unless you explicitly opt in.

4.2 Subscriptions
  • Subscription fees are charged in advance and are non-refundable except as required by law
  • Subscription renewals occur automatically unless you cancel before the next billing cycle
  • You may cancel at any time through your account settings or by contacting support@zuno.fit
  • Cancellation takes effect at the end of the current billing cycle; you will continue to have access until then
4.3 ZunoCoins
  • ZunoCoins are an in-app loyalty mechanism with no monetary value outside the Platform
  • ZunoCoins may be redeemed against subscription billing, subject to per-cycle caps
  • ZunoCoins cannot be earned during the trial period
  • ZunoCoins expire upon account closure and have no cash value
  • We reserve the right to modify the ZunoCoins program with reasonable notice
4.4 Refunds

All payments are final and non-refundable except where required by applicable law. If you believe you are entitled to a refund, contact support@zuno.fit within 7 days of the charge with the reason for your request.

4.5 Price Changes

We may change subscription prices with at least 30 days’ prior notice. Changes will take effect at your next renewal.

5. User Conduct

You agree NOT to use the Platform to:

  • Violate any applicable law, regulation, or third-party rights
  • Impersonate any person or entity, or misrepresent your identity, age, or affiliation
  • Provide false health information that could result in inappropriate recommendations
  • Use the Platform if you are not legally of age (under 18)
  • Distribute, share, or resell Platform content without authorization
  • Reverse engineer, decompile, or attempt to extract source code from the Platform
  • Interfere with or disrupt the Platform’s security, integrity, or performance
  • Use automated systems (bots, scrapers, crawlers) to access the Platform
  • Upload malicious code, viruses, or harmful content
  • Harass, threaten, or harm other users (where community features exist)
  • Use Platform content for any commercial purpose without our written consent

6. Intellectual Property

6.1 Our Ownership. The Platform, including all content, software, designs, trademarks, logos, recipes, workout plans, and the Zuno.Fit brand, is owned by or licensed to the Company. All rights are reserved.

6.2 Limited License. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes only.

6.3 Your Content. Any content you submit to the Platform (progress photos, reviews, feedback) remains your property, but you grant us a worldwide, royalty-free license to use, modify, and display such content in connection with the operation and improvement of the Platform.

6.4 Trademark Notice. “Zuno.Fit” is a trade name of Kiala Technologies Private Limited. Unauthorized use is prohibited.

7. Limitation of Liability

LIMITATION OF LIABILITY — IMPORTANT

7.1 No Warranty. The Platform is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

7.2 Health Outcomes. We do NOT warrant that the Platform will:

  • Achieve any specific health, fitness, weight loss, weight gain, or wellness outcome
  • Be suitable for your specific health condition, body type, or lifestyle
  • Be free from errors, inaccuracies, or unsuitable recommendations
  • Operate without interruption or be free from technical issues

7.3 Maximum Liability. To the maximum extent permitted by law, the total liability of the Company and its directors, officers, employees, and affiliates to you for any claim arising out of or relating to the Platform shall not exceed the greater of:

    (a) The amount you have paid to us in the 12 months preceding the claim, or

    (b) Five Thousand Indian Rupees (INR 5,000)

7.4 Excluded Damages. In no event shall the Company be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, personal injury, illness, emotional distress, or property damage, even if the Company has been advised of the possibility of such damages.

7.5 Health-Related Exclusion. Without limiting the above, the Company shall not be liable for:

  • Any injury, illness, adverse health reaction, or other harm resulting from your use of the Platform
  • Any decision you make based on Platform content, including following or modifying any plan
  • Any worsening of an existing medical condition
  • Any death or disability arising from use of the Platform

8. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, contractors, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of or inability to use the Platform
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property or privacy right
  • Any injury, illness, or harm resulting from your use of the Platform or reliance on its content
  • Your providing false or misleading information to the Platform
  • Any third-party claim brought against the Company in connection with your use of the Platform

9. Assumption of Risk

Assumption of Risk.

By using the Platform, you understand and voluntarily assume the inherent risks of exercise, dietary changes, and lifestyle modifications, including but not limited to:

  • Musculoskeletal injury (strains, sprains, fractures, joint injury)
  • Cardiovascular events (heart attack, stroke, fainting)
  • Metabolic disturbances (hypoglycemia, electrolyte imbalances)
  • Allergic reactions to foods or supplements
  • Worsening of existing medical conditions
  • Aggravation of mental health issues, including disordered eating
  • Hospitalization, disability, or in extreme cases, death

You acknowledge that you assume all such risks and waive any claims against the Company arising from these risks.

10. Account Termination

10.1 By You. You may terminate your account at any time through Settings → Account → Delete Account, or by emailing privacy@zuno.fit.

10.2 By Us. We may suspend or terminate your account at any time, without notice, if we believe you have:

  • Violated these Terms
  • Provided false information
  • Engaged in fraudulent or harmful conduct
  • Been a danger to yourself or others
  • Failed to pay applicable subscription fees

10.3 Effect of Termination. Upon termination, your right to access the Platform ceases. Sections that by their nature should survive termination (including Sections 3, 7, 8, 9, 11, 12, 13) shall continue to apply.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts at Bangalore, Karnataka, India.

12. Dispute Resolution

12.1 Good Faith Negotiation. Before initiating any legal proceeding, you agree to first contact us at legal@zuno.fit to attempt to resolve the dispute in good faith.

12.2 Arbitration. If the dispute cannot be resolved through negotiation within 30 days, the parties agree to refer the matter to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by mutual consent, in Bangalore, Karnataka, in English.

12.3 Class Action Waiver. You agree to resolve disputes only on an individual basis. You waive any right to participate in a class action or representative proceeding against the Company.

13. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated to you by email or in-app notification at least 14 days before they take effect. Your continued use of the Platform after modifications constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Platform.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Platform and supersede all prior agreements.

16. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce it later.

17. Force Majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, internet failures, or pandemics.

19. Acknowledgement

BY CLICKING “I AGREE”, BY CREATING AN ACCOUNT, OR BY USING THE PLATFORM IN ANY WAY, YOU CONFIRM THAT:

  1. You have read these Terms in their entirety, including the Medical Disclaimer in Section 3
  2. You understand the risks and limitations of using a fitness and nutrition application
  3. You agree to consult appropriate healthcare professionals before following any plan
  4. You accept full responsibility for your health and safety
  5. You release and indemnify the Company from claims arising from your use of the Platform
  6. You are at least 18 years of age and have the legal capacity to enter into this agreement
  7. You agree to be bound by these Terms
